Terms & Conditions
These Terms and Conditions (“Terms”) govern the relationship between Joe Solar Ltd (“we”, “us”, “our”) and the customer (“you”) in connection with the supply and installation of solar photovoltaic (PV) systems and related products and services.
Please read these Terms carefully before accepting a quotation or signing any agreement with us. By proceeding with a booking or installation, you confirm that you accept these Terms.
1. Quotations and Acceptance
- All quotations are valid for 30 days from the date of issue unless otherwise stated.
- A contract is formed when you sign and return our quotation or letter of agreement, and we confirm acceptance in writing.
- Quotations are based on information provided by you and/or a site survey. If the actual conditions differ materially, we reserve the right to revise the price.
- We reserve the right to withdraw or amend a quotation at any time before a contract is formed.
2. Site Survey
- Where required, we will conduct a site survey prior to installation to assess suitability.
- You agree to provide accurate information about your property, roof structure, and electrical system.
- If the survey reveals that the agreed installation is not feasible, we will discuss alternatives or cancel the agreement without charge.
3. Installation
- We will agree an installation date with you. Dates may be subject to change due to weather, supply chain delays, or other factors beyond our control.
- You must ensure reasonable access to the property and roof on the agreed installation date. Failure to do so may result in additional charges.
- Installation will be carried out by qualified engineers in accordance with MCS standards and relevant UK regulations, including BS 7671 (IET Wiring Regulations).
- Any remedial work required to your existing electrical installation before we can proceed will be quoted separately and is not included unless stated.
- We will notify your local Distribution Network Operator (DNO) where required. You are responsible for any requirements or costs imposed by the DNO.
- We will carry out all reasonable care to avoid damage to your property. Any accidental damage must be reported to us immediately and will be addressed at our discretion.
4. Price and Payment
- The price payable is as stated in your quotation.
- Unless otherwise agreed, a deposit of 25% is due upon signing the agreement, with the balance due on completion of installation.
- We accept payment by bank transfer, debit card, or approved finance products. We do not accept cash payments exceeding £100.
- If you fail to make payment by the due date, we reserve the right to charge interest at 8% per annum above the Bank of England base rate under the Late Payment of Commercial Debts Act 1998.
- All prices are inclusive of VAT at the applicable rate (currently 0% for qualifying residential solar installations).
5. Finance
- Finance products are provided by third-party lenders and are subject to their own terms and conditions.
- We are a credit broker, not a lender. Finance is subject to status and affordability.
- Approval of finance does not guarantee installation until all documentation is completed.
6. Warranties and Guarantees
- Workmanship warranty: We provide a 2-year workmanship guarantee on all installations.
- Panel warranty: Solar panels are typically covered by a 25-year product and performance warranty from the manufacturer.
- Inverter warranty: Inverter warranties vary by manufacturer and will be confirmed in your documentation.
- Battery storage: Battery warranty terms vary by manufacturer and will be confirmed at the time of quotation.
- Warranties are valid only where the system has been used in accordance with manufacturer guidelines and has not been modified or tampered with by unauthorised persons.
- Warranties do not cover damage caused by extreme weather events, acts of God, or failure of your property’s electrical infrastructure.
7. MCS Certification
- All eligible installations will be registered under the Microgeneration Certification Scheme (MCS).
- MCS certification is required to access the Smart Export Guarantee (SEG). Obtaining SEG payments is the customer’s responsibility and is not guaranteed by Joe Solar Ltd.
- We will provide you with all necessary MCS documentation upon completion of the installation.
8. Your Responsibilities
- You are responsible for ensuring planning permission is obtained where required. We can advise on this but cannot apply on your behalf.
- You are responsible for notifying your home insurer of the installation.
- You must ensure the system is maintained in accordance with the manufacturer’s guidelines.
- You must not modify, repair, or tamper with the system yourself or instruct unqualified persons to do so, as this will void warranties.
9. Cancellation Rights
- If the contract was formed at your home or by distance means (e.g. online or by phone), you have the right to cancel within 14 days without reason under the Consumer Contracts Regulations 2013.
- If installation has commenced at your request within the 14-day period, you may be liable for reasonable costs incurred.
- After 14 days, cancellation is only permitted by mutual agreement. We reserve the right to retain the deposit or charge a cancellation fee to cover costs incurred.
- To cancel, please contact us in writing at info@joesolar.co.uk or by post.
10. Liability
- Our total liability to you in connection with any contract shall not exceed the total price paid by you for the relevant installation.
- We are not liable for any indirect, consequential, or economic losses including loss of profit, loss of energy savings, or loss of business.
- Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.
- We are not responsible for system underperformance caused by shading, weather conditions, or changes to your energy usage pattern.
11. Force Majeure
We will not be in breach of these Terms if we are prevented from performing our obligations by circumstances beyond our reasonable control, including but not limited to extreme weather, supply chain disruption, government restrictions, or industrial action. We will notify you as soon as reasonably practicable and reschedule work at the earliest opportunity.
12. Complaints
If you have a complaint, please refer to our Complaints Procedure. We are committed to resolving disputes fairly and promptly.
13. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes that cannot be resolved through our complaints procedure may be referred to the courts of England and Wales.
14. Changes to These Terms
We may update these Terms from time to time. Updated Terms will apply to new contracts entered into after the date of update.
